This Disclosure Notice has been prepared pursuant to Article 10 of the Turkish Personal Data Protection Law No. 6698 (“KVKK” or the “Law”) in order to inform visitors to the berkalan.com website (the “Website”) about the processing of their personal data.

Limited technical data obtained for Website security and technical operation may, in particular, be processed on the basis of legitimate interests relating to the secure and functional operation of the Website.

Communications concerning a potential project or business relationship may, depending on the circumstances, be processed on the basis that they are directly related to the establishment or performance of a contract or on the basis of the data controller’s legitimate interests.

METHODS OF COLLECTING PERSONAL DATA

RETENTION OF PERSONAL DATA

Personal data is retained for the period necessary for the purpose for which it is processed and for any retention periods required by applicable legislation.

Where the purpose of processing no longer exists and there is no other legal basis requiring the retention of personal data, the relevant data will be deleted, destroyed or anonymised in accordance with applicable legislation.

Technical and security logs may be retained for limited periods necessary for Website security and operation.

Professional correspondence may be retained for as long as necessary depending on the nature of the relevant enquiry, project or business relationship.

SECURITY OF PERSONAL DATA

Under Article 11 of the KVKK, you have the right to:

  • learn whether your personal data is being processed
  • request information if your personal data has been processed
  • learn the purpose of processing your personal data and whether it is being used in accordance with that purpose
  • know the third parties to whom your personal data has been transferred in Türkiye or abroad
  • request correction of your personal data if it has been processed incompletely or inaccurately
  • request the deletion or destruction of your personal data under the conditions provided for by the Law
  • request notification of correction, deletion or destruction operations to third parties to whom your personal data has been transferred
  • object to any result arising against you as a result of the analysis of processed data exclusively through automated systems
  • claim compensation for damages suffered as a result of the unlawful processing of personal data

APPLICATIONS TO THE DATA CONTROLLER

You may submit requests concerning your rights under Article 11 of the KVKK to Berk Alan through one of the methods specified in Article 13 of the Law and the Communiqué on the Procedures and Principles of Application to the Data Controller.
